Juglo Terms

1. General Information - What there is to know about Juglo's terms

1.1
Juglo permit the access to its services on the base of these here stated terms and conditions. The terms regulate the relationship between Juglo and the registered users, as well as the relationships between the users themselves.

1.2
Juglo's terms apply for all of the all content, functions and other services (collectively "services"), which Juglo provides to the Juglo network. For special services there can be an additional arrangement between a user and Juglo (collectively "additional terms"). Juglo will indicate those additional terms to the user wherever applicable.

1.3
The usage of special services, especially such that require the agreement on additional terms, can be limited to certain users or user groups only.

2. Registration - How to start using Juglo

The use of the Juglo Service is provided only to registered users. The Registration to the Juglo Service is free of charge.

2.1
The use of Juglo is intended solely for users who are eighteen (18) years of age. If you are not eighteen years of age and using Juglo, you are violating these terms and using the Service unlicensed and unauthorized. By registering to Juglo the user represents and warrants that he is at least eighteen years of age or older.

2.2
Any user is allowed to sign up to Juglo only once and assure at his registration that he has no other accounts registered or that he has already deleted any such accounts (see 4.1).

2.3
Registration at Juglo starts with the user filling out the registration form. The user must enter only true information in the mandatory fields provided and must not use any pseudonyms or nicknames when signing up. No Company names, brand names, or any other word then the true details of the user are allowed to be entered as names.

2.4
Juglo will confirm the user registration immediately by sending an automated email to verify the provided email address. Only when the user clicks on the verification link, he agree to the terms and conditions and the contract between the user and Juglo is established.

2.4.1
After email verification the user can use the service provided in the user panel. He can access the user panel by providing his email address and password.

2.4.2
Should a user not click the verification link in a given time span, Juglo will delete the account and the to date submitted information about the user.

2.5
The user has no right to demand to a user contract. Juglo can delete a registration with or without cause. In this case all submitted information from the user will be deleted immediately.

2.6
There is only limited technical possibility for Juglo to identify people online and Juglo cannot assure that there are no users registered with wrong, misleading or fake user details. Juglo does not warrant for the identity of its users. Its every users sole responsibility for checking another user's identity.

3. Termination - How to stop using Juglo

3.1
Should a user want to stop using Juglo and delete his profile, he can do so at any time with or without cause and without complying with any term. For deleting his profile he just needs to send a short email stating his request for profile deletion to support@juglo.com

3.2
Also Juglo has the right to terminate the user contract at any time by giving a 14 days notice. The right to delete a profile with a good cause in paragraph 6. of these terms is not affected by this.

3.3
With account deletion the profile will be closed and not accessible anymore. The user cannot login or retrieve his saved information from us after an account has been deleted.

4. Subject Matter - What Juglo has to offer

4.1
Through the Juglo Service users can access a variety of applications, specifically:

+ editable profile page and similar ways to upload, edit and create data and content, such as text, pictures and graphics, that can be accessed by the public, by certain user groups or only by the user himself.

+ intelligent agent to provide user with self promotion information and guidance.

+ automated search engine optimization services

4.2
Of course is Juglo striving to always improve its services and capabilities. Nevertheless is the amount of data that can be saved for every user limited.

4.3
The user has no claim to use the services other than within the current technical capabilities of the system. For the same matter there may arise situations in which some or all services will have limited availability or will not be available at all. This might happen for releasing load capacity on the Juglo servers, for upgrading a component of Juglo, for security reasons or for any other technical arrangements to assure the proper working of Juglo. Juglo will inform its users of such planned technical measurements by posting it on the website.

4.4
Juglo can reference information or service of a third party, especially with links. This third party content is recognizable as such by indication (e.g. "Advertisement") When and if the third party offers a contract, this contract is solely made by the user and the legally responsible of the third party.

5. User Obligations - What Juglo expects from its users

So that Juglo can host so many users, each and everybody has to stick to some certain rules:

5.1
The User is obliged to provide only true and non-misleading statements in the User profile and in communications with other users, and to refrain from using any pseudonyms or pen names.

5.2
The user must post on Juglo only photographs of the user and not of anything else. The photographs delivered by the User shall not contain any company logos.

5.3
The user has to comply his actions with all applicable legislation, and respect all third-party rights. In particular, the user shall not publish, write or create any insulting, discriminating or defamatory content. Posting, advertising, promoting or offering of any pornographic materials or any contents that violate any applicable legislation for the protection of minors is prohibited for Juglo users. The user shall also not use or promote any commercial practices considered unfair competition, including progressive customer acquisition practices (such as chain distribution systems or pyramid sales).

5.4
The user must not unreasonably annoy any other user or the Juglo network with spam.

5.5
Use without authorization any contents protected by law (e.g. by copyright, trademark, patent, utility patent, or design patent laws), or advertise, promote, offer or distribute any goods or services protected by law.

6. Sanctions - What happen if one doesn't comply the terms

6.1
Obeying these terms and in particular the rules in 5. is crucial for the Juglo network to function and give the best results for every user. Therefore Juglo has the right to sanction any user that violates a law (US state laws, national laws, Austrian law and European Law), infringes the rights of others, or in any other way does not comply with rules and the morality of the Juglo network. Further it is Juglo's right to remove unlawful or discreminating content from its network without notice.

6.2
To decide which sanctions to impose on a user, if any, Juglo will consider the interests of the user and will examine whether the misconduct was deliberate or unintentional. Thereafter Juglo can will take none or more of the following actions:

+ partial or complete deletion of user content

+ admonishment of the user

+ temporary blocking of user's account

+ permanent blocking of users account

+ temporary of permanent blocking of Users IP address

6.3
If a user's account has been blocked, he is not allowed to log on to Juglo's network anymore. He must also not register any other account at Juglo.

7. Liability

7.1
Juglo is not obligated by law to monitor the data and information on its network and will not search for illegal actions and/or content on the network. If Juglo should however find such data, information or actions, it will make those unavailable to the public

7.2
Whatever the legal grounds, liability for damage claims based only on ordinary negligence against Juglo shall exist only if Juglo breaches a basic/cardinal obligation under this agreement. In this event, the amount of claims are limited to typical and foreseeable damages. IN ANY CASES SHALL CLAIMS NEVER EXCEED THE AMOUNT OF MONEY PAID BY A USER FOR ANY SERVICE ON THE JUGLO NETWORK.

8. Data Protection - The content on the Juglo network

8.1
The basic idea of the Juglo-Network is to make its users' information public and to further promote the information the users provide and the users themselves. Nevertheless it is the users choice which information he wants to publish to the public and which information is only available for certain groups of users. The user further has the choice of whether or not to publish anything on his profile. The handling and publishing of users' information is outlined in Juglo's privacy policy. A user who does not agree to this privacy policy should not use Juglo and shoud refrain from signing up.

8.2
It is prohibited for users to take information from other users and give it to third parties, to use this information to spam users with advertisement of any kind (print, sms, email, private messages).

8.3
It is Juglo's right to have information about any name on its network. This information, which is automatically generated by the Juglo software, will be displayed in a different manner and there will be a note on the same page that this is content generated and is not written by or written about any specific person with this name. If somebody should come across information about his name, he can either sign up to edit the information himself, or contact Juglo and Juglo will either change the content or make it inaccessable for the public. NOBODY SHALL HAVE ANY CLAIM AGAINST JUGLO FOR USING THEIR NAME AND PUBLISHING FICTIONAL INFORMATION ABOUT IT. THE INFORMATION IS NOT ABOUT ANY SPECIFIC PERSON, COMPLETELY RANDOMELY GENERATED BY COMPUTER SOFTWARE AND HAS NOTHING TO DO WITH THE REAL WORLD.

8.4
Although it is in Juglo's best interest to save any data on its network and we are backing up our databases on a regular basis, there is no guarantee for saving the data. Juglo is not liable by law for any loss of data, and users are solely responsible for saving and backing up their data and information that is important to them. If the user wants to have a permanent copy of the information on Juglo it is his own reposonsiblity to download and save the information or print it out for permanent storage of any kind.

9. Changes to the terms

9.1
Changes to the terms here can be made by Juglo at any time without cause and the changes will be made public on the Juglo website. It is every users responsiblity to check the Juglo's terms for changes and a user can terminate the contract with Juglo if he does not agree to the new terms.
